1. Acceptance of Terms

By downloading, installing, accessing, or using the SugarWise mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SugarWise ("we," "us," or "our").

2. Description of Service

SugarWise is a health and fitness application that provides:

• Nutrition tracking and sugar monitoring
• Calorie and macronutrient counting
• AI-powered food scanning and analysis
• Personalized nutrition goals and recommendations
• Progress tracking and analytics
• Healthy recipe suggestions
• AI diet coaching and support

3. Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 18 years old, you must have permission from a parent or legal guardian to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. Account Registration and Security

4.1 Account Creation

To access certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account

4.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

5. Subscription and Payment

5.1 Subscription Plans

SugarWise offers subscription-based access to premium features:

• Monthly Subscription: Billed monthly at the current rate
• Annual Subscription: Billed annually at the current rate (discounted)

Subscription prices are subject to change. We will notify you of any price changes in advance.

5.2 Payment Processing

Payment will be charged to your App Store (Apple) or Google Play (Android) account upon confirmation of purchase. All payments are processed through the respective app store platforms.

5.3 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.4 Free Trial

We may offer a free trial period for new subscribers. If you do not cancel before the trial period ends, you will be automatically charged for the subscription.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation will take effect at the end of the current billing period. You will continue to have access to premium features until the end of the paid period.

6.2 Refunds

Refund requests are handled according to the App Store and Google Play refund policies. We do not directly process refunds. Please contact Apple or Google for refund requests.

7. User Responsibilities and Prohibited Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Attempt to gain unauthorized access to the App or our systems
• Reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scrapers) to access the App
• Upload malicious code, viruses, or harmful content
• Impersonate another person or entity
• Harass, abuse, or harm other users
• Share your account credentials with others
• Use the App in a way that could damage, disable, or impair our services

9. Intellectual Property Rights

The App and all its content, features, and functionality (including but not limited to software, text, graphics, logos, icons, images, and algorithms) are owned by SugarWise and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App.

10. User-Generated Content

You retain ownership of any content you create or upload to the App (such as food photos, custom recipes, or notes). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely to provide and improve the App's services.

11. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUGARWISE AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or health consequences resulting from use of the App
• Errors or inaccuracies in nutritional information or AI analysis
• Interruptions, delays, or unavailability of the App
• Unauthorized access to or alteration of your data

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13. Indemnification

You agree to indemnify, defend, and hold harmless SugarWise and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload or submit to the App

14. Termination

14.1 Termination by You

You may terminate your account at any time by visiting our Delete Account page or contacting support@thesugarwise.com. Upon termination, your data will be deleted within 30 days.

14.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the App at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abusive or harmful behavior
• Non-payment of subscription fees
• Any other reason at our sole discretion

15. Changes to the App and Terms

15.1 App Updates

We may update, modify, or discontinue any features of the App at any time without notice. We are not liable for any modifications or discontinuation of the App.

15.2 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App or on our website. We will notify you of significant changes via email or in-app notification.

Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and cancel your subscription.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through:

3. Arbitration: If mediation fails, disputes shall be resolved through binding arbitration

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SugarWise regarding the use of the App and supersede all prior agreements and understandings.
